By accessing and buying this website we assume you agree to be legally bound by these terms and conditions (in full) and any additional specific terms which may apply to certain goods. Do not continue to use Emma Lacey Limited's website if you do not accept all of the terms of service stated on this page.

Under the Consumer Contracts (information, cancellation and additional charges) regulations 2013 we are required to give certain information which are contained within these terms and conditions, on our website and within the product descriptions.

The following terminology applies to these Terms of Service, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms of service. "The Company", "Ourselves", "We", "Our" and "Us", refers to Emma Lacey Limited. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing law of United Kingdom. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Your contract with us.

As soon as a client places an order in our website We will acknowledge the order by sending the client an email confirmation but this is not acceptance of the order. Orders will be fully accepted once we have received full payment for the order which cannot be later than 7 days after the order being placed. There are certain circumstances in which we will not accept orders:
-when the goods are out of stock
-if payments are not fully or correctly processed or received by us
-if there is a mistake on the prices of the goods and services
-if we have any suspicions of fraudulent activity
-if we foresee problems with the delivery
-if we decide against it due to internal company reasons

In the case that we decide not to accept an order, we will let the client know as soon as possible.

Orders on this website will be fulfilled/despatched within 5-7 days of payment being received and we cannot/will not post any orders until payment has been received in full.
Orders will be safely packed and handed to the agreed courier; we use Parcel Force, Royal Mail, GLS and DHL for our deliveries.
Under this contract we will work with CPT (Carriage Paid To) terms, by which we agree to pack the order, arrange the delivery of the client’s order and hand the order to the carrier (either at our premises on collection or at another safe agen for drop off). When available we will provide tracking numbers and method to sutilise these. However, once this is handed to the agreed delivery company (or first carrier, in case the delivery involves more than one company), the responsibility for communicating with the delivery company and arranging safe delivery lies with the client.
Orders will be sent with no insurance unless requested and agreed differently at the time of the contract.


Our duty to supply purchased goods

We adhere to relevant legislation or codes of conduct (i.e. Consumer Protection from Unfair Trading Regulations 2008).

Delivery
Joanna Ingram Ceramics ships anywhere in the UK using Royal Mail recorded delivery, therefore a signature will be required. In the event that there is nobody to sign for the parcel, Royal Mail will leave a note with directions for collection. If you do not collect your item from the post office within the time stipulated on the card and the item is returned to Emma Lacey, we reserve the right to charge for re-postage.
In some cases we might use DHL, most non-European international deliveries, in which case we will use a recorded service and therefore a signature will be required. In the event that there is nobody to sign for the parcel, DHL will leave a note with directions for collection. If you do not contact or follow the steps provided to rearrange delivery of your item within the time stipulated on the card and the item is returned to Joanna Ingram, we reserve the right to charge for re-postage.

Packing
All of our orders are carefully packaged using sustainable materials when possible. However, although we try not to, in some cases we have to use polystyrene chips or other materials due to availability or to provide better padding.

Delivery Prices
We offer the following delivery services and prices:

UK
For parcels under 0.35 kg (including packing) - £6.50 – Royal Mail First Class Signed For/Parcel Force
For parcels between 0.36 kg and 0.7kg (including packing) - £10.00 – Royal Mail First Class Signed For/Parcel Force Next Day Delivery Service (where available in the UK)
For parcels over (including packing) - £12.00 – Royal Mail First Class Signed For/Parcel Force Next Day Delivery Service (where available in the UK)

Europe
Due to the changes that have taken place since the UK ceased to be a member state of the EU we cannot sell to European countries via our website due to a technical limitation.

We do continue to sell to Europe but orders will have to be placed via email. We trade under a Delivered At Place (DAP) policy which means that we will sell the products and arrange delivery but we are not responsible for import costs, such as VAT, duties, and clearing fees. We will always attach a customs form (CN23) when necessary and attach it to your parcel when shipping to EU countries. We will remove the UK VAT for every piece but you might be subject to paying a customs fee on your country prior to delivery, we are very sorry but we cannot estimate what this will be at this point.

European orders are processed with Parcel Force International, managed by Parcel Force whilst in the UK and normally handed over to GLS, Parcel Force European Partner


USA
For parcels under 0.4 kg (including packaging) - £25.00 Using DHL
For parcels between 0.4 kg and 3kg (including packaging) - £50.00 Using DHL
For parcels over 3kg ( including packaging) - £100.00 Using DHL

RETURNS (and exchanges)

Our ceramics are hand made with great care and pieces may vary slightly due to the process, however if you are unhappy with your purchase please contact us.

If you wish to return your piece to us, please contact us first, then ensuring the piece is in its original condition (unused and unmarked) send it to us within 14 days of receipt, in order for us to arrange an exchange or refund. Once a piece has been used, we can no longer accept the product as a return for refund. Please ensure you have proof of postage as we accept no liability for loss of returns in the post. Please note we are unable to refund postage costs. We do not accept unauthorised returns under any circumstances and we are sorry, but we do not reimburse the postage on items that are being returned unless they are faulty.

Cancellations
If you wish to cancel your order before it has been posted out to you, then please confirm this by email as soon as possible and we will reimburse you the cost within 30 days. If the order has already been posted but not received, we will not refund the value for delivery charges and will only be able to process the refund after the order has been returned safely to our premises.
